Energy Autopilot™ Terms And Conditions
These Terms govern your use of Energy Autopilot™, the energy bill management service operated by Electricity Ratings, LLC. By signing up or using our services, you agree to these Terms. If you do not agree, please do not use the service.
1. What Energy Autopilot™ Does
Energy Autopilot™ is a subscription service that helps you manage your home energy account. We monitor your electricity (and where available, natural gas) usage, watch the market for better-priced supply plans, and — with your written authorization — enroll you in a new plan when it makes sense. We also keep an eye on your billing, flag possible errors, and provide tools to help you understand your usage.
Energy Autopilot™ is provided by Electricity Ratings, LLC, a licensed energy broker and aggregator in the states where we operate.
2. Eligibility
To sign up for Energy Autopilot™, you must:
- Be at least 18 years old.
- Be the named account holder (or authorized representative) on the utility bill you want us to manage.
- Live in a state where retail energy choice is available and where Energy Autopilot™ is offered.
- Provide accurate and current account information.
3. Authorization (Letter of Authorization)
By signing up, you grant Electricity Ratings, LLC a Letter of Authorization (LOA) to act on your behalf in dealings with your utility and energy suppliers. This authorization allows us to:
- Access your account information, billing history, and usage data from your utility.
- Communicate with your utility and suppliers regarding your account.
- Enroll you in supply contracts that you have approved (in writing, by email, by text, or through our app).
- Cancel or switch suppliers on your behalf when authorized by you, in line with the plan terms.
The LOA does not give us authority to make changes you have not approved. You can revoke the LOA at any time by contacting us.
4. Plan Switching and Renewals
We will only switch you to a new energy supply plan at the end of your current contract term, unless you direct us otherwise. Before any switch, we will provide you with the plan details, including price, term length, and any early termination fees, and obtain your approval.
If you cancel a supply contract before its term ends, your supplier may charge an early termination fee. Energy Autopilot™ is not responsible for fees imposed by your supplier.
5. Fees and Billing
Subscription Fee: Energy Autopilot™ is offered on a subscription basis. The current price, billing frequency, and any promotional offers are disclosed at the time of signup.
Payment Method: You authorize us to charge the payment method on file for recurring fees. If a charge fails, we may suspend the service until payment is resolved.
Refunds: Subscription fees are generally non-refundable, except where required by law. If you cancel, you will retain access through the end of your current billing period.
Utility Bills: You remain responsible for paying your utility and supplier bills directly. Energy Autopilot™ does not pay your energy bills for you.
6. Your Account
You are responsible for keeping your account credentials secure and for all activity that happens under your account. Let us know promptly if you suspect unauthorized access.
You agree to provide accurate information and to keep it up to date. If you provide false or misleading information, we may suspend or terminate your account.
7. Communications
By signing up, you agree to receive communications from Energy Autopilot™ related to your account, including emails, text messages, and app notifications. These may cover plan recommendations, contract renewals, bill alerts, service updates, and account verifications.
You can opt out of marketing messages at any time by following the unsubscribe instructions in each message. You cannot opt out of transactional messages (such as account confirmations or contract notices) while you remain a customer. See our SMS Terms and Privacy Policy for full details.
8. Data and Privacy
We collect, use, and store your information as described in our Privacy Policy. By using Energy Autopilot™, you consent to that collection and use. We share information with your utility, suppliers, and service providers only as needed to deliver the service.
9. Cancellation and Termination
By You: You may cancel your Energy Autopilot™ subscription at any time through the app, your account dashboard, or by contacting customer support. Cancellation takes effect at the end of your current billing period.
By Us: We may suspend or terminate your account if you violate these Terms, provide false information, fail to pay subscription fees, or use the service in a way that creates risk for us or other customers.
After cancellation, any active supply contracts you have with a third-party supplier remain in effect under the supplier's terms; we no longer manage them on your behalf.
10. Acceptable Use
You agree not to use Energy Autopilot™ to:
- Misrepresent your identity or another person's authority over an account.
- Interfere with the service, its security, or other users' use of it.
- Reverse engineer, scrape, or copy any portion of the service except as expressly permitted.
- Use the service for any unlawful purpose.
11. Third-Party Suppliers
Energy Autopilot™ recommends and enrolls you in supply plans offered by third-party energy suppliers. We are not the supplier and do not generate, deliver, or bill for electricity or natural gas. Your relationship with the supplier is governed by that supplier's contract, which we will provide to you for review and approval before any enrollment.
We are not responsible for a supplier's pricing decisions, billing errors, service disruptions, or any other actions taken by the supplier.
12. No Guarantee of Savings
We work to find plans that fit your usage and goals, but we cannot guarantee specific savings. Energy markets fluctuate, and a plan that is favorable when you enroll may not remain so. We will keep monitoring on your behalf, but past results do not guarantee future outcomes.
13. Disclaimer of Warranties
The service is provided "as is" and "as available." Electricity Ratings, LLC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free from harmful components.
14. Limitation of Liability
To the maximum extent permitted by law, Electricity Ratings, LLC and its affiliates, officers, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from or related to your use of Energy Autopilot™. Our total liability to you for any claim related to the service is limited to the amount you paid us in the twelve months before the claim arose.
15. Indemnification
You agree to indemnify and hold harmless Electricity Ratings, LLC and its affiliates from any claims, losses, or expenses (including reasonable attorneys' fees) arising from your use of the service, your violation of these Terms, or your violation of any law or third-party right.
16. Dispute Resolution and Arbitration
Most issues can be resolved by contacting customer support. If a dispute cannot be resolved informally, you and Electricity Ratings, LLC agree to resolve it through binding arbitration, except as noted below for specific states.
Arbitration will be conducted by the American Arbitration Association under its Consumer Arbitration Rules, and must be filed within one year of the dispute arising. Arbitration hearings will be held in Harris County, Texas. You and Electricity Ratings, LLC each agree to arbitrate individually — class actions are not permitted. Texas law governs these Terms. If Electricity Ratings, LLC brings a claim against you, it will be filed in the courts of Harris County, Texas.
Section 16 arbitration does not apply to Ohio customers. Ohio disputes are governed by Ohio law and heard in Ohio courts.
17. Miscellaneous
Waiver: If Electricity Ratings, LLC does not act on a violation immediately, that does not mean we waive our right to act later.
Availability: We work hard to keep services running, but planned maintenance or events outside our control may cause temporary downtime. We will not be liable for any resulting unavailability.
Entire Agreement: These Terms (along with our Privacy Policy) make up the complete agreement between you and Electricity Ratings, LLC. If any part of these Terms is found unenforceable, the rest still applies.
18. State-Specific Rules
